Medical Malpractice Bill Approved by the House

A bill approved by the House, will limit the damage awards in some medical malpractice lawsuits at one million dollars.

Last night, lawmakers voted 110 to three for the bill, which was supported by both lawyers and doctors.

The North Carolina Academy of Trial Lawyers and the North Carolina Medical Society both supported the bill. The limitations apply to cases of negligence, but only to those that agree to binding arbitration.

The bill will help to speed the resolution and duration of smaller lawsuits.

Doctors have blamed rising malpractice insurance premiums on multimillion-dollar awards by what they called runaway juries. Trial attorneys wouldn't agree to award limits sought by doctors and hospitals, saying patients need financial protection for mistakes by the truly worst physicians.
